THE APPLICANT, BANYAN HYPNOSIS CENTER, HAS OPERATED AT THIS LOCATION SINCE 2019.

UH, THEY WERE GRANTED A SPECIAL PERMIT AT THAT TIME FOR HYPNOSIS TRAINING CENTER.

UM, THAT WAS PERMIT WAS SPECIFICALLY TIED TO SUITE 2 45 IN THE BUILDING.

SO THIS REQUEST IS LOOKING TO RELOCATE WITHIN THE BUILDING TO

A DIFFERENT SUITE, UM, TO A SMALLER SQUARE FOOTAGE AND CONTINUE THEIR USE.

UH, THAT THE USE OF A HYPNOSIS TRAINING CENTER IS STILL AN UNLISTED USE AND IT DOES REQUIRE A NEW SPECIAL PERMIT.

AND SO THAT'S WHY IT'S COMING BACK TO YOU FOR CONSIDERATION.

THE, UM, THIS IS A VIEW, UH, FROM INSIDE THE BUILDING OF SUITE 2 0 5 WHERE THEY'RE LOOKING TO RELOCATE.

IT'S, UM, THE SUITE SPACE IS JUST UNDER 1500 SQUARE FEET.

UH, THEY USE THE SITE FOR ADMINISTRATIVE OFFICES AND THEY HAVE THREE FULL-TIME EMPLOYEES.

THEY DO THERAPY SERVICES TO INDIVIDUAL CLIENTS, AND MOST OF THOSE ARE BY ZOOM.

THEY DO PROVIDE ONSITE HYPNOSIS TRAINING PROGRAMS. THE TRAINING PROGRAMS ARE SCHEDULED FOR THREE TO FOUR TIMES A YEAR.

THE SESSIONS ARE SEVEN DAYS LONG AND TYPICALLY BETWEEN 9:00 AM AND 6:30 PM THEY HAVE AROUND SIX STUDENTS THAT HAVE TAKEN THE COURSE ON SITE AND THE REST PARTICIPATING ONLINE.

THE APPLICANT INDICATED THAT THEY CAPPED THE IN-PERSON ATTENDANCE AT EIGHT PER CLASS.

UM, LAST YEAR THEY HELD TWO COURSE SESSIONS AND HAD A TOTAL OF 12, UM, PARTICIPANTS THAT CAME ON SITE.

AND 11 STUDENTS THAT, UM, WERE ONLINE.

THEY HAVE OFFERED UP TO FOUR COURSES A YEAR.

AND MOST STUDENTS THAT COME ON SITE, THEY ARE TYPICALLY STAYING IN A NEARBY HOTEL.

AND SO THEY'RE WALKING OR TAKING A CAR, UM, CAR SERVICE TO ACCESS THE SITE.

THE SITE DOES MEET THE PARKING REQUIREMENTS FOR AN OFFICE OF THIS SIZE, UM, WITH ONE, UH, ONE ADDITIONAL SPACE, UH, OVER THEIR REQUIRED MINIMUM.

UM, AND CONSIDERING IMPACTS OF THIS USE, THE BUSINESS HAS OPERATED FOR ALMOST FIVE YEARS AT THIS LOCATION, AND STAFF IS NOT AWARE OF ANY COMPLAINTS OR ISSUES THAT, UM, DURING THAT OPERATION THIS PERMIT REQUEST WAS NOTICED.

AND WE HAVEN'T RECEIVED ANY CORRESPONDENCE, UM, ON THE ITEM AT THIS.

AS OF THIS TIME, UH, THE IMPACT OF THE STUDENT AND EMPLOYEE TRAFFIC TO THIS SITE HAS BEEN VERY MINOR.

AND THEN THE NATURE OF THE SPECIFIC REQUEST OF THE TRAININGS IS THAT THEY ARE INTERMITTENT AND SHORT TERM AND, UM, WHICH IS CONSISTENT WITH A GENERAL OFFICE USE THAT MIGHT HAVE OCCASIONAL TRAININGS OR EVENTS ON THE SITE.

UM, AND SO IT IS SHOWN AT THIS TIME TO NOT WARRANT ANY ADDITIONAL PARKING NEEDS.

SO STAFF HAS PROVIDED THE COMMISSION, UM, WITH THE FOLLOWING CONDITIONS.

UH, SHOULD THE, THE COMMISSION, UM, RE UH, RECOMMEND APPROVAL, UM, THIS IS, WAS INCLUDED IN YOUR STAFF REPORT, THE PROPOSED CONDITIONS, UM, DO REQUEST TYING THE APPROVAL TO THE BUILDING AND THIS SPECIFIC BUSINESS OPERATOR, BUT NOT TO A SUITE OR SQUARE SQUARE FOOTAGE.
